Official Rules

Contest Details:

1. Promotion/Contest (the “Contest”) Name: PHOTOGRAPHY BY JOHN GANNON INSTAGRAM GIVEAWAY
2. Entry deadline is 03/15/17 at 11:59 PM PST
3. To enter: ‘Follow’, ‘Like’ and comment AS INSTRUCTED on the giveaway post between 03/09/17, at 7:00 PM, PST, and 03/15/17, at 11:59 PM, PST. (“Entry Period”). Entrants must provide all information requested to be eligible to win and receive prize. Incomplete, unreadable, or unintelligible entries will be disqualified. All entries must be received by 03/15/17, at 11:59 PM, PST. Winners will be notified via tagged Instagram comment.
   • Alternative Entry Method: Please e-mail sweeps@element.gs with “CONTEST ENTRY” in the subject line, and your your Instagram account name in the body. One entry maximum, Sponsor not responsible for technical errors, lost entries, typos, or any other uncontrollable or unforeseen event beyond reasonable control of the Sponsor.
4. Prizes and Odds: The one (1) prize to be awarded from the giveaway is: One (1) 16×24 canvas print with a retail value of approximately $253.00 (USD).
   • Total value of all prizes to be awarded: $253.00 (USD).
   • The odds of winning a prize depend on the total number of eligible entries received.
   • Please allow 6-8 weeks for delivery of prizes.
5. Eligibility: The Contest is open to legal residents of the U.S. age 18 or older (or with signed parent/guardian approval, see below), who have an active Instagram account, e-mail account and Internet access, as of the beginning of the Contest period.
6. Prize Drawing: All entries meeting the requirements of these “Official Rules” will be entered into the prize drawing, to be held on or around 24 hours after the online deadline. The winners will be selected at random from among all eligible entries received using an online random response generator.
7. The odds of winning a prize depend on the total number of eligible entries received. Winners are solely responsible for any and all federal, state, and local taxes that apply to prizes. No cash or other substitution of prizes is permitted. Prizes won by minors will be awarded to the parents or legal guardians, who must sign all required affidavits and releases in accordance with local, state and federal laws. In the event of the prize being lost or stolen during shipment, the Sponsor will have the sole discretion as to the ability to replace. Replacement is not required by Sponsor but all best efforts will be made.
8. Notification of Winners: Winners will be notified by Instagram direct message within 24 hours of the entry deadline. Winners will have up to five (5) days of the prize drawing to respond or they will forfeit their winning. If a selected Winner cannot be contacted, is ineligible, fails to claim a prize and/or where applicable, prize may be forfeited and an alternate Winner will be selected from remaining valid, eligible entries timely submitted. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the Instagram account specified in the entry. “Authorized account holder” is defined as the natural person who is assigned to the Instagram account entered. No automatically generated entries will be accepted and entries from automated services will be automatically disqualified.
9. Privacy Policy: Any personal information supplied by you to the Sponsor will be subject to Sponsor’s Privacy Policy posted at http://www.element.gs/main/?page_id=366. The Sponsor will not sell, rent, transfer or otherwise disclose your personal data to any third party unless as indicated above in situations required to ship orders, prizes, or traditional correspondence. Additionally, by entering the Contest you understand that the Sponsor may send you additional commercial marketing email regarding the Sponsor and its partners.
10. General Rules: By entering, you agree to be bound by these Official Rules. The Contest is offered by Sponsor, which is not responsible for late, lost, delayed, damaged, postage-due, incomplete, illegible, or misdirected entries, responses, or other correspondence, whether by e-mail or postal mail or otherwise, or for theft or destruction or unauthorized access or alterations of entry materials, phone, electrical, network, computer, hardware, software program or transmission malfunctions, failures or difficulties. By participating and winning a prize, Winner releases Sponsor, its parent, affiliates, subsidiaries, directors, officers, employees, sponsors, and agents, including advertising and promotion agencies, from any and all liability with respect to the Contest or the acceptance, possession or use of any prize, including without limitation:
    • (i) any condition caused by events beyond Sponsor’s control that may cause the Contest to be disrupted or corrupted;
    • (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in this Contest; and
    • (iii) any printing or typographical errors in any materials associated with the Contest. Sponsor’s decisions in all respects relative to the Contest are final. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Contest in whole or in part, in the event of fraud, technical or other difficulties or if the integrity of the Contest is compromised, without liability to the entrant.
11.  Sponsor reserves the right to disqualify any winner, as determined by Sponsor in its sole discretion.
12. The winner is responsible for paying any income taxes on the value of the prize received. Void where prohibited or restricted by law.
13. All federal, state, provincial and local regulations apply.
14. Additional Conditions: Except where prohibited by law, by accepting any prize, Winner consents to the use of his/her name, photo and/or likeness, biographical information, winning entry and statements attributed to winner (if true) for advertising and promotional purposes without additional compensation. All entries become property of Sponsor and none will be acknowledged or returned. Please allow 6-8 weeks for delivery of prizes.
15. Winner’s List, Official Rules: For a list of prize winners or a printed copy of these Official Rules, send your request and a stamped, self-addressed envelope to Photography by John Gannon, 236 N Santa Cruz Ave., Suite 236 Los Gatos, CA 95030 or (for Winner’s list only) send an e-mail message to info@element.gs with “Winner’s List” as the email subject and contest name specified in the body of the e-mail.
